These general conditions apply to all offers and sales of Linco Baxo Industrie Refrattari S.p.A. unless expressly agreed otherwise in writing. In case of conflict, the specific terms stated in our written offer and order confirmation prevail.
Unless otherwise stated, our offers are valid for 30 days from their date, force majeure excepted. Quoted prices apply to the quantities stated in the offer; failing that, they apply only to industrial quantities purchased on a rotating basis, and not to call-on / call-off purchases. In view of the continuing volatility of energy and raw-material costs, we reserve the right to notify adjustments to prices or delivery times against the conditions stated in an offer before order confirmation.
All products are manufactured in our own Italian plants:
Castables and unshaped products — Levate plant (BG), Italy.
Bricks and shaped products — Maref plant, Bondeno (FE), Italy.
Precast and prefabricated products — Tecref plant, Zerbinate di Bondeno (FE), Italy.
Products are supplied in accordance with their technical data sheets, whose instructions for storage, preparation and installation form an integral part of the supply and must be strictly followed; the complete instructions are collected in the Linco Baxo Site Handbook, available from our technical team and in the Client Portal. The Linco Baxo quality system is certified to ISO 9001:2015 (Lucideon, certificate No. 24527). Quality testing is performed at our central laboratory in Levate (BG) and managed in accordance with the Linco Baxo standard Inspection & Test Plan provided with the offer. Additional or witnessed tests can be quoted separately on request.
Unshaped products are packed in multilayer paper bags, boxes or drums as specified in the relevant technical data sheet, palletised and shrink-wrapped. Shaped products are supplied on pallets, shrink-wrapped. Pallets (indicative gross weight 1–2 tonnes depending on the material) are included in the price. On request, materials can be prepared and secured for container shipment.
Delivery terms are agreed at offer or order stage and construed in accordance with the latest edition of the Incoterms®. Goods are ready for shipment or collection within the number of working days stated in our order confirmation, running from receipt of the official purchase order and our sales confirmation, depending on product type, quantities and agreements in place.
When stored in accordance with the Site Handbook, dry castables have a shelf life of 12 months from the production date and wet or otherwise perishable materials 6 months; shaped refractories and other non-perishable products have no expiry date. All refractory products must be stored in a cool, dry and ventilated warehouse, in their original packaging, off the ground.
Payment terms are agreed at negotiation, offer or order stage. All bank charges outside Italy are for the account of the payer. All commercial terms are subject to the seller's standard credit assessment of the buyer.
Installation supervision by a Linco Baxo specialist is available as an optional, separately quoted service. While not mandatory, it is recommended for critical linings: our supervisor supports the installation crew on site, verifies correct preparation and installation, and helps ensure the lining performs as designed.
Linco Baxo products are covered by product liability policy No. 06100000746 with QBE Insurance Europe Limited, up to a total value of EUR 5,000,000.00. To the maximum extent permitted by law, Linco Baxo shall not be liable for indirect or consequential damages or losses of any nature, however caused. Bill-of-material calculations, consultancy, engineering and installation-related services are provided in good faith on the basis of the information supplied by the customer, and Linco Baxo accepts no liability in respect of them towards the customer or third parties.
Since the manufacturer cannot know or control the conditions in which its products are used, it is the user's responsibility to determine the suitability of any product for the intended use. Technical data represent typical values obtained under laboratory conditions in accordance with the referenced standards.
Offers are based on the tariffs and laws of the European Union in force at their date. The latest edition of the Incoterms® and these General Terms & Conditions of Sale apply to all our sales.
